1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website and services operated by AquaVita Mineral Water Trading LLC (“AquaVita”, “we”, “our”, or “us”). By accessing, browsing, or placing an order through our website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree with these Terms, you must not use our website or services.
2. Service Coverage
AquaVita currently provides bottled and gallon mineral water delivery services within the Emirate of Dubai, United Arab Emirates only. We reserve the right to expand or modify our service areas in the future without prior notice.
3. Eligibility
By using our services, you represent and warrant that you are at least 18 years of age and legally capable of entering into a binding contract under the laws of the United Arab Emirates.
4. Orders & Online Payments
4.1 All orders placed through our website are subject to availability and acceptance by AquaVita.
4.2 Payments may be made through:
- Online payment gateways (credit/debit card)
- Bank transfer
- Cash on Delivery (COD)
- Cash or card payment via Point of Sale (POS) machine at the time of delivery
4.3 For online payments and bank transfers, AquaVita will proceed with delivery to the address provided by the customer at the time of placing the order.
4.4 For Cash on Delivery or POS payments at delivery, the customer or an authorized person must be present at the delivery address to complete payment at the time of delivery. AquaVita reserves the right to cancel or reschedule the order if payment is not received.
5. Service Fee
AquaVita applies a 2.5% service fee on the total order value for all purchases made through the website. This fee supports and enhances service efficiency, delivery operations, and overall service quality. This fee does not apply to cash-based or offline orders unless otherwise stated.
6. Coupon Book Policy
6.1 AquaVita offers a Coupon Book as a prepaid service option for customers.
6.2 Each Coupon Book is valid for one (1) year from the date of purchase.
6.3 Coupons are non-transferable, non-refundable, and cannot be exchanged for cash.
6.4 Lost, stolen, or damaged Coupon Books will not be replaced.
6.5 In the event that a customer who has purchased a Coupon Book does not request a bottle exchange or delivery for a continuous period of two (2) consecutive months, AquaVita reserves the right, for asset management and operational purposes, to request the return of any empty gallon bottles currently held by the customer, even if there are remaining valid coupons in the Coupon Book.
This measure does not affect the validity of the remaining coupons, and the customer may resume requesting deliveries at any time in the future, subject to these Terms and Conditions.
7. Delivery Policy
7.1 Delivery will be made to the address provided by the customer during checkout.
7.2 Customers are responsible for ensuring that the delivery address and contact details are accurate.
7.3 AquaVita is not responsible for delays caused by incorrect addresses, customer unavailability, or circumstances beyond our reasonable control.
8. Bottle Deposit & Asset Protection
8.1 AquaVita reserves the right to request a refundable deposit of AED 25 per gallon bottle for any order exceeding three (3) gallon bottles.
8.2 This deposit is intended to protect AquaVita’s assets and ensure the return of reusable gallon bottles.
8.3 The deposit will be refunded upon the return of the bottles in acceptable condition, subject to inspection by AquaVita.
9. Lost or Damaged Bottles
9.1 Customers are fully responsible for the safekeeping of all gallon bottles provided by AquaVita.
9.2 In the event of loss, theft, or complete damage to any gallon bottle, the customer agrees to pay a replacement fee of AED 25 per bottle.
9.3 AquaVita reserves the right to recover its assets or charge the applicable replacement fee upon termination of service.
10. Cancellation & Refund Policy
10.1 Orders once placed may only be eligible for cancellation or refund in cases of:
- Delivery failure caused by AquaVita
- Damaged or defective products at the time of delivery
10.2 Any refund requests must be submitted within a reasonable time and are subject to review and approval by AquaVita.
11. Limitation of Liability
To the fullest extent permitted by applicable law, AquaVita shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website, services, or products.
12. Privacy & Data Use
All personal information collected through our website is handled in accordance with our Privacy Policy and applicable UAE data protection laws.
13. Termination of Service
AquaVita reserves the right to suspend or terminate access to its services at its sole discretion in the event of a breach of these Terms or misuse of services.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai.
AquaVita reserves the right to pursue legal action before the courts of Dubai to resolve disputes and to recover any outstanding financial dues or company assets from customers, in accordance with and within the scope of these Terms and Conditions and applicable laws.
